Key Responsibilities -
- Undertake inspections of work sites to ensure compliance with Council’s Local Laws and permits, Road Management Act 2004, Environmental Protection Act 2017, Planning and Environment Act 1987 and other relevant legislation.
- Ensure investigations are fully detailed on Council’s database providing comprehensive reasoning for decisions in accordance with Council’s agreed procedures.
- Proficiently interpret relevant legislation, policy, fundamental technical information, and approved drawings/plans.
- Instigate appropriate enforcement action, including education, warnings, Notice to Comply, Infringement Notices and EPA Notices.
- Produce high standards of evidence and investigation records within Council’s databases.
- In consultation with management, instigate prosecution in Magistrates Court and Victorian Civil Administration Tribunal (VCAT), prepare briefs, liaise with the legal team, give evidence as required and manage prosecution to a conclusion.
- Where appropriate, provide coaching and advice to Asset Protection (AP) Enforcement Officers.
- Will seek guidance on more complex matters and assist the Supervisor and Team Leader in investigating more serious or complex issues.
- Ensure accurate records of inspections conducted, and any enforcement action in any enforcement action instigated is updated in the relevant database in a timely manner.
- Report Risk Management concerns to the relevant department.
- Deliver first-class customer service practices and ensure a consistent approach across the team.
- Resolve issues raised by customers regarding damage to Council infrastructure assets and work by owners, buildings, developers and utility companies.
SELECTION CRITERIA
1.
Demonstrate knowledge of the Local Government Act, Council’s Local Laws, Road Management Act, Planning and Environment Act, Road Management (Works and Infrastructure) Regulations 2015 and any other relevant legislation
2.
Completion of a Certificate IV in Government Compliance, Diploma in Justice or equivalent and/or relevant experience in the relevant field of Local Law.
3.
Demonstrate previous experience and knowledge of the functions of an Asset Protection Officer/ and /or Compliance Officer related to building sites and public authorities to ensure compliance with permits, consents, Local Laws, and relevant legislation.
4.
Prior experience in undertaking surveillance of road related activities with the ability to audit Traffic Management plans and public protection measures on worksites.
5.
Proven experience in investigation and enforcement procedures and providing evidence in court.
6.
Ability to exercise personal judgment to prioritise work to meet service levels.
7.
Ability to effectively communicate both verbally and in written form with property owners, builders, and developers in an authoritative, but respectful manner seeking cooperation to gain compliance.
8.
Demonstrate ability to provide surveillance and protection function for Council to ensure builders and public authorities works are carried out and reinstated appropriately by taking a proactive approach to enforcement of matters related to the team’s objectives.
9.
Current driver’s licence applicable to Victorian State Government regulations.
